Strasius Prevails in Legal Malpractice and Conspiracy Case

September 21, 2012

Anthony P. Strasius (Partner–Miami) recently obtained a dismissal with prejudice of a legal malpractice and conspiracy lawsuit against Wilson Elser's attorney client. The underlying lawsuit alleged that the attorney helped dispose of and hide marital property in a divorce involving a Venezuelan multimillionaire accused of selling homes, cars and yachts without his wife's knowledge and hiding the proceeds.

Mr. Strasius moved to dismiss the complaint, arguing that Florida law does not recognize a claim for civil conspiracy for the illegal transfer of property. He further argued that the plaintiff failed to properly assert the basis for damages incurred as a result of actions or omissions by Wilson Elser's client. After extensive briefing and oral argument, the court granted the motion to dismiss with prejudice and entered final judgment in favor of the firm's client.

Mr. Strasius represents clients at the trial and appellate levels in cases involving products liability, medical malpractice, toxic torts, general liability, professional malpractice, commercial liability and international matters.
