Authors: Carl J. Pernicone, Loren S. Cohen
Agents of America, an association dedicated to the personal and professional growth, stability and management of its agent members and their agencies, has published an article co-authored by Carl Pernicone (Partner-New York) and Loren S. Cohen (Partner-Chicago), in its newsletter, as well as posted the article on its website. The article entitled, “Illinois Appellate Court Endorses All Sums Allocation Rule for Asbestos Bodily Injury Losses under Excess and Umbrella Insurers,” discusses the March 5, 2013 decision by the First District Appellate Court in John Crane, Inc. v. Admiral Insurance. The appellate court ruled that excess and umbrella insurers covering asbestos-related injury claims are jointly and severally liable under an “all sums” allocation method, refusing to adopt the insurers’ argument that a pro rata time-on-the-risk approach applies.
