Houston Attorneys Win Summary Judgment on a Bad Fuel Claim

Gwendolyn S. Frost (Of Counsel-Houston) and Michelle R. Scheiffele (Associate-Houston) won summary judgment in an insurance coverage case involving a claim of bad fuel. The case was venued in the District Court of Gillespie County, Texas.
The plaintiff, an insured, submitted a claim to the defendant insurance company for engine damage that resulted from him purchasing poor quality diesel fuel for his truck. The insurance company denied the claim as his automobile insurance policy specifically excluded coverage for damage resulting from the mechanical breakdown and/or failure of the insured vehicle. On these grounds, Wilson Elser filed a motion for summary judgment, and the court agreed thereby dismissing the case.
