Lalit Loomba Authors Article on Governmental Immunity in Negligence Cases

Lalit K. Loomba (Of Counsel-White Plains) has written an article entitled, "Governmental Immunity in Negligence Cases: Recent Developments," for Municipal Lawyer, a publication of the Municipal Law section of the New York State Bar Association. The article, which appears in the Spring 2011 publication, reports on the recent decision by the Court of Appeals in McLean v. City of New York that significantly expands the scope of municipal immunity in negligence cases, as well subsequent decisions by lower courts which reveal a reluctance to follow the new rule set forth.


The article provides an historical perspective on municipal immunity in New York, key decisions that led up to McLean, information about the decision, implications of that decision and reactions to it. As the article states, municipal immunity is an important defense in negligence cases. This article provides municipal officials and lawyers with vital information to better understand this area of the law and where it appears to be heading.


Mr. Loomba's practice focuses on the defense of municipalities and municipal officials. He has extensive experience in Section 1983 cases involving police officers and also represents municipal and corporate clients in employment discrimination and retaliation cases.
