Corleto Obtains Defense Verdict on Legal Malpractice Counterclaim and Full Recovery of Attorney's Fee

December 5, 2016

Tony Corleto (Partner-Stamford) secured a defense verdict for a matrimonial attorney after three weeks of evidence in a legal malpractice case. The claimant, a former client of the attorney, counterclaimed for malpractice, misrepresentation and infliction of emotional distress related to a final award of legal and physical custody to her former spouse. The claimant, who represented herself pro se, also sought to link a post-representation seizure and automobile accident to the legal services. At trial, Tony and Tara secured rulings that precluded evidence of the seizure, the accident, testimony of her neurologist and testimony of her current therapist. They also secured favorable testimony from a therapist who treated the plaintiff during the representation. After one hour of deliberation, the jury returned a defense verdict on the malpractice claim and a full award of fees owed to the attorney from his representation of the claimant.
