Severino Prevails in End Dump Accident Case

Mark Severino (Associate-Las Vegas) obtained a complete defense verdict in a semi-trailer end dump accident case after a six-day jury trial in the state of Nevada, Clark County District Court. The plaintiff claimed he was permanently disabled when his vehicle rolled over while he was dumping a load of dirt. He alleged that the rollover was caused by a mechanical failure of his end dump’s hydraulic ram, and that a certified DOT inspection and maintenance facility was at fault for negligently inspecting and/or maintaining the end dump trailer. During cross-examination of the plaintiff, he obtained testimony that he attempted to raise this 44-ton end dump trailer while it was stopped at an angle on a side slope in soft dirt, with two low/flat rear right tires. Similarly, on cross-examination of the plaintiff’s mechanical engineering experts, the Wilson Elser team was able to conclusively prove that there was no evidence of any mechanical failure, no evidence of a negligent inspection and no evidence to show that the facility negligently maintained the end dump trailer. Mark did not call any lay or expert witnesses in its case-in-chief. After a 90-minute deliberation, the jury rendered a unanimous defense verdict with 0 percent liability.
