Semlies and Grady Obtain Jury Verdict in Case Alleging Negligence in CT Procedure

Lori Semlies (Partner-White Plains) and Michael Grady (Partner-White Plains) obtained a defense verdict for a hospital client after a three-week trial in Putnam County, New York. The claims involved an alleged negligently performed CT (computerized tomography) scan that delivered contrast at a rate in excess of the hospital’s policy and resulted in a serious extravasation leading to compartment syndrome and a fasciotomy in addition to other surgeries. The plaintiff, a 51-year-old woman, claimed to have developed Complex Regional Pain Syndrome not only in her affected and dominant arm but also in her leg, which prevented her from walking without assistance. The demand before trial was $2.9 million. In summation, the plaintiff’s attorney asked the jury to award his client $5 million. The jury was out for 45 minutes and found no departures against the hospital or the technician.
