Ng and Mullins Obtain Defense Verdict in Orthopedic Surgery Case

Richard Ng (Partner-New York) and Kathleen Mullins (Associate-New York) secured a defense verdict on behalf of a major New York City hospital and the head of the hospital’s Foot & Ankle Surgery Division. The plaintiff alleged that defendants (1) improperly fused the first metatarsal during orthopedic foot surgery to correct severe bunion and hammertoe deformities, resulting in permanent foot pain, impaired ability to perform activities of daily living and the need for revision surgery with joint replacement, and (2) failed to sufficiently advise the patient of the risks, benefits and alternatives to the foot fusion surgery. Richard and Kathleen successfully convinced the jury that the fusion surgery was properly performed and achieved the intended results. With respect to the claim for lack of informed consent, defendants successfully established that during the lengthy pre-surgery discussion, the plaintiff was adequately advised of the risks, benefits and alternatives to the procedure.
