Murphy-Petros Secures Affirmance of Dismissal for Client in Fatal School Bus Accident

Melissa Murphy-Petros (Partner-Chicago) prevailed before the U.S. Court of Appeals for the Sixth Circuit, which affirmed dismissal of claims against the firm’s client, a private school bus company that transports public school children. This case arose out of the nationally publicized 2016 school bus crash in Chattanooga, Tennessee. Plaintiff filed suit in federal court alleging that our clientis a state actor for purposes of section 1983. The district court granted our pre-answer motion to dismiss brought on the ground that our client is not a state actor and the Sixth Circuit affirmed. Melissa handled both the motion to dismiss in the district court and the briefing and oral argument of the appeal. The Sixth Circuit decision was reported in Law360 on November 1, 2018.
