Grace and Barker Obtain Summary Judgment in Wrongful Death Aviation Case

Kathryn Grace (Partner-McLean) and Lori Barker (Of Counsel-New Orleans) obtained summary judgment for an aviation company in a wrongful death case in the Civil District Court for the Parish of Orleans, State of Louisiana. A plane carrying two passengers on a sunset tour crashed into Lake Pontchartrain near the landing pad. One passenger and the pilot drowned after impact. The second passenger was able to escape and was rescued by a nearby boat. The surviving family members of the deceased passenger filed suit alleging wrongful death and survival actions. The surviving passenger filed suit alleging personal injuries and emotional damages. Various defendants were named, including our clients who allegedly provided tainted fuel and/or improperly maintained the aircraft. Grace and Barker moved for summary judgment with supporting affidavits stating that our clients adhered to industry standards and that the services provided by our client did not contribute to the crash. The trial judge granted the motion for summary judgment in its entirety.
