Eli Secures Verdict for Chicago Transport Company Client

December 13, 2018

Lamis Eli (Associate-Chicago) first-chaired a transportation trial in the Circuit Court of Cook County before Judge Axelrood in which she defended a town car company and its driver following an accident with a Chicago taxi cab near O'Hare Airport. The plaintiff, a passenger in our client’s vehicle, claimed to have suffered a compression fracture in her cervical spine and ongoing pain as a result of the accident. The taxi company and its driver were codefendants. Our driver claimed to have been stopped in gridlocked traffic when the taxi crashed into them. Plaintiff's testimony corroborated our account while the taxi driver claimed that we cut him off and abruptly stopped for no reason, denying that there was traffic on the road. The jurors were given a special interrogatory along with their jury instructions and verdict forms at the end of closing that read "Did you find that the taxi cab driver was the only cause of the collision between his vehicle and the vehicle of the town car company driver?" The jurors all answered yes to this special interrogatory and apportioned complete liability to the taxi cab driver. The jury arrived at its verdict after 2.5 hours; the codefendant was found responsible for 100 percent of the liability and $220,000 in damages.
