Law360 Quotes Newman on Florida Supreme Court Reversal of Case against Anesthesiologist

Ben Newman (Partner-Orlando) was quoted in a January 9, 2019, Law360 article, “More Fla. Docs Face Med Mal Risk After Appeals Court Ruling.” The article reported on the Florida Supreme Court’s recent reversal of a directed verdict in favor of an anesthesiologist accused of negligently clearing a woman for surgery, who treated the patient for only five minutes while filling in for another anesthesiologist running late. The justices said a directed verdict was improper because evidence had been presented that plausibly alleged at least partial blame. “A lot of patients have pre-surgery clearance with cardiologists or primary care physicians several days before surgery,” said Ben. “I can foresee where plaintiffs’ attorneys may be bolstered by this opinion and think they may be able to include physicians not present that day who may have arguably committed medical negligence.”
