Jordan, Maraynes and Kuljis Obtain Defense Verdict in Decubitus Ulcer Case

Laura Jordan (Partner-White Plains), Sean Maraynes (Associate-White Plains) and Zoran Kuljis (Associate-White Plains) represented a family practice physician and sub-acute rehabilitation facility in a case that sounded in medical malpractice, nursing home negligence and public health law violations related to the progression of a decubitus ulcer from Stage II to Stage IV. The plaintiff’s last demand was $500,000 and he sought punitive damages. Sean tried the case and obtained a defense verdict after a five-day trial in Nassau County, Supreme Court. Our defense focused on the fact that the decedent’s skin breakdown was inevitable due to various underlying medical conditions and to her lack of compliance with her treatment regimen. The plaintiff's credibility was significantly hampered at trial when he denied admissions made during his deposition, taken by Zoran. The plaintiff's counsel's plastic surgery expert was discredited in part through an email he sent to another Wilson Elser attorney soliciting business last year, which the attorney had retained.  The jury returned a defense verdict after approximately 90-minutes of deliberations.
