Katt, Kearns, Sweeney and Geary Obtain Dismissal of Products Liability Cases in Utah and California Involving Utah Plane Crash

William Katt (Partner-Milwaukee), Patrick Kearns (Partner-San Diego), Scott Sweeney (Of Counsel-Denver) and Kevin Geary (Associate-Milwaukee) recently obtained dismissal of multiple wrongful death product liability lawsuits on behalf of a Wisconsin-based manufacturer and distributer of aircraft components. The three cases – venued in Utah State Court and in the U.S. District Courts for the District of Utah and the Southern District of California – stemmed from an airplane crash in Utah. The plaintiffs in each case alleged that fuel drain valves manufactured and sold by our client caused the fatal crash. Using a multiple office collaborative approach, the Wilson Elser team successfully argued that our client did not have sufficient contacts with either Utah or California for those states to exercise personal jurisdiction over our client. The courts in each case agreed, deciding the matters solely on the briefs. Consequently, all claims against our client related to the subject crash were dismissed with prejudice.
