Daily Journal Quotes White on COVID-19-Related Insurance Litigation

Paul White (Partner-Los Angeles) commented on the more than 1,000 business interruption claims in the United States related to COVID-19 in “Business Interruption Rulings on Covid Appear to Be in Favor of Insurers,” an article that appeared in the September 9, 2020, edition of Daily Journal. Addressing the most pertinent issues – what constitutes physical loss or damage and whether the policy has a virus exclusion – Paul points to a recent Michigan decision that addressed “both the direct physical loss component as well as the virus exclusion and found that an analysis of both would preclude coverage for the business interruption claim, finding that direct physical loss requires tangible damage.” He concludes that insurers are encouraged by the early rulings thus far, though hundreds of cases have not yet been decided.
