Nicol Obtains Summary Judgment Based on Alternate Employer Endorsement
Marjorie Nicol (Of Counsel-Houston) obtained summary judgment on behalf of a print-advertisement sorting plant client arising out of a forklift accident. The plaintiff brought suit against the plant, which had retained plaintiff on a temporary basis through a staffing agency. The contract between the plant and the staffing agency provided that the agency was to obtain workers’ compensation insurance and an alternate employer endorsement naming the plant. The staffing agency complied. Marjorie moved for summary judgment arguing the alternate employer endorsement meant the plant enjoyed the same protection from suit as did the staffing agency, namely the workers’ compensation bar. The Chief Judge of the Southern District of Texas agreed and granted summary judgment.
