Franco Obtains Dismissal of Tenant in Porch Collapse Case

Bret Franco (Partner-Chicago, IL) obtained dismissal with prejudice on behalf of a tenant-insured in a porch collapse case. The case involved five consolidated cases arising from a second-floor porch collapse that occurred in 2018, causing significant injuries to multiple party attendees. Bret represented the first-floor tenant who was alleged to have co-hosted the party, where the deck collapsed with more than 20 people on it. Bret argued that our client had no duty to the plaintiffs as a tenant with no knowledge of the latent construction defect that allegedly caused the porch to collapse. Judge Ehrlich in the Circuit Court of Cook County, Illinois agreed and granted the motions to dismiss with prejudice.  Christen McGlynn (Associate-Chicago, IL) assisted in writing the briefs.
