Lawless Successfully Defends a “Targeted Victim” Case on Appeal

Patrick Lawless (Partner-New York, NY) successfully defended a “targeted victim” case in New York’s Appellate Division, First Department in which a panel of judges upheld the New York Supreme Court’s decision in a case where the mother of a shooting victim sued Wilson Elser’s client, a public housing development, for negligence involving the death of her daughter. The plaintiff alleged that the development failed to provide adequate security, which allowed her daughter’s assailants to gain access to their building. The underlying case established that locks were recently checked for functionality. Patrick argued that the assailants were intent on revenge and would have been able to gain access to the building regardless of the presence of bystanders, security cameras or locked doors, successfully upholding his client’s prior verdict.
