Murphy-Petros Obtains Reversal on Criminal Conviction in Pro Bono Appeal

Melissa Murphy-Petros (Of Counsel-Chicago, IL), who is a member of the Illinois Supreme Court’s Volunteer Pro Bono Program for Criminal Appeals, obtained a reversal on a conviction for criminal trespassing in Illinois Appellate Court, Second District. Melissa’s pro bono client was sentenced to 24 months’ probation following a jury trial, and Melissa was able to obtain a new trial on the grounds that the client had received ineffective assistance from trial counsel the first time around; the public defender failed to advance a defense that would have resulted in acquittal and failed to request the appropriate limiting instructions regarding highly prejudicial impeachment evidence. Alexandrea Diaz (Associate-Chicago, IL) conducted research on the case and assisted in drafting the opening appellant’s brief.
