Williams Achieves Defense Verdict in Construction Defect Case

Ryan Williams (Partner-Denver, CO) achieved a defense verdict in a construction defect case for the firm’s client construction company, brought by the owner of a self-storage facility in the Denver metropolitan region in Colorado District Court, Arapaho County. The plaintiff asserted claims against the project’s general contractor, alleging that the composite concrete floors for three of the building’s four floors exhibited excessive cracking. Claiming that a comprehensive structural repair was necessary, the owner presented the jury with a proposed repair cost of nearly $3 million. The general contractor, while denying liability, asserted claims against the firm’s client, who placed and finished the concrete on each of the floors. The general contractor argued that if a defect existed, its subcontractor bore complete liability for any resulting damages. Following a defense built on expert testimony concerning industry standards for performance, inherent design limitations and a lack of provable damages, Ryan achieved a defense verdict for the client on all claims for relief, and the client is pursuing costs of litigation as a prevailing party.
