Blair, Goldhaber and Wagner Obtain Summary Judgment in Accident Case
Chicago partners Kimberly Blair and David Goldhaber and associate Sean Wagner obtained summary judgment in the Circuit Court of Cook County for a construction manager and resident engineer, after an eight-hour hearing. The case stems from a limousine accident in 2016 in which an underage, unlicensed limo driver caused a crash that resulted in one death and several serious injuries of the passengers inside of the vehicle. Following the accident, the passengers filed suit against 24 construction and engineering entities involved in the design of the roadway and the ongoing construction near the scene of the accident, including the firm’s client. With more than 125 fact witnesses and the production of some 250 gigabytes of documents, photographs and videos, defendants argued that the limousine driver was the sole cause of the accident. Furthermore, the judge stated that the defendants reasonably could not have designed the roadway for the actions of an unqualified driver, and granted summary judgment.
