Stephenson Secures Defense Jury Verdict for Local Homebuilder

Jeremy Stephenson (Of Counsel-Charlotte, NC) obtained a jury verdict of no liability in Buncombe County Superior Court in defense of a local homebuilder and its CEO against claims of significant bodily injury to a third party on a jobsite. The plaintiff, upset about the construction next to his house, walked onto the jobsite and started a fight with one of the insured's employees. As the insured's CEO pulled the two parties apart, the plaintiff’s leg was broken in a compound fracture. Against a demand of $800,000, Jeremy argued no liability under the "defense of another" statute providing civil immunity and the jury agreed in a unanimous defense verdict on behalf of the firm’s client.
