Adams and Hollis Prevail on Improper Joinder Argument Following Removal
Kent Adams (Partner-Houston, TX) and Danielle Hollis (Associate-Houston, TX) were successful in keeping a suit brought by an injured dump truck driver against our client and six John Does in federal court. They had previously removed based on diversity. Once the plaintiff identified the six John Does through discovery, he sought leave of court to bring them in via an amended petition. These John Does were employees of our client and, if named as defendants, would destroy diversity jurisdiction. Kent and Danielle responded, raising the argument of improper joinder, an effective weapon in the fight for federal court jurisdiction, and were successful in keeping the matter in the much more favorable federal forum.
