Freeman and Driskill Obtain Summary Judgment on Behalf of Insurance Client
Nicholas Freeman (Partner-Orlando, FL) and Gerry Driskill (Associate-Orlando, FL) successfully argued a motion for summary judgment on behalf of an insurance company in Orange County Circuit Court, Florida. The plaintiff condominium association commenced a lawsuit against its property insurers, including the firm’s client, for alleged damage to condominiums caused by Hurricane Irma. The plaintiff sought damages in excess of $300,000 as well as significant attorney’s fees and costs. Nick and Gerry filed a motion for summary judgment, arguing the insurer clients had been prejudiced in their investigation of the claim due to the plaintiff’s actions in undertaking significant repairs to the property and pursuing a property damage claim against a subsequent insurer prior to providing notice of the claim. At the hearing, Gerry argued the plaintiff failed to provide sufficient evidence as required by Florida’s new summary judgment standard. The court agreed with these submissions and granted final summary judgment in favor of our client and the other insurers.
