Holland and Lauricella Secure Least Severe Penalty for Physician before New York Board of Professional Medical Conduct

Andrew Holland (Of Counsel-Albany, NY) and Peter Lauricella (Partner-Albany, NY) represented a physician before the New York Board of Professional Medical Conduct (BPMC) in a negligence case, and obtained the least severe penalty available by statute for the client. The physician, who practices in Maryland and is licensed in New York State, was disciplined in Maryland for negligence. The New York Office of Professional Medical Conduct (OPMC) subsequently commenced a reciprocal proceeding to discipline him against his New York license for the Maryland misconduct and delivered a severe punishment, including the possibility of losing his license. Lori, Peter and Andrew rejected the decision and went to the BPMC where context was provided for the negligence charges and the client detailed his extensive medical career. The BPMC imposed a censure and reprimand, but no additional penalty.
