Flannery Obtains Dismissal of Civil Rights / Religious Land Use and Institutionalized Persons Act Claim

John Flannery (Partner-White Plains, NY) obtained a decision from the Southern District of New York dismissing a civil rights / Religious Land Use and Institutionalized Persons Act (RLUIPA) claim brought by a New York State chartered education corporation for both secular and Orthodox Jewish girls against a township, its supervisor and a citizen’s group. The corporation claimed that the town and supervisor engaged in certain activities that thwarted its effort to purchase a former Baptist church and school for conversion into an Orthodox Jewish girls’ school. The case received considerable media attention. The lowest settlement demand that the Town received was $25 million plus attorneys’ fees.
