Harrison and Dorman Win 12-0 Verdict in Dental Malpractice Suit
Robert Harrison (Partner-San Diego) and Jessica Dorman (Associate-San Diego) secured a 12-0 verdict in San Diego Superior Court on behalf of Wilson Elser’s client, an endodontist, in a case involving a dental malpractice claim. The plaintiff lost in an action against a large food chain after alleging she suffered a broken tooth eating a hamburger containing a hard foreign object. The plaintiff subsequently sued our client, who performed a root canal 8 days after the incident, alleging the treatment resulted in the development of post-traumatic trigeminal neuropathy. The plaintiff’s counsel asked the jury to award a total of $437,000, which included future medical care expenses. Our client prevailed as the plaintiff’s claims failed to establish negligence or a causal relationship arising from the endodontist’s actions. Also brought to light was that despite alleging experiencing severe symptoms, plaintiff had not sought neurologic or pain consultation for 2 years and 8 months as of the date of the trial.
