Estrada and Lee Prevail on Summary Judgment in Employment Lawsuit

Diana Estrada (Partner-Los Angeles) and Dan Lee (Of Counsel-Los Angeles) obtained summary judgment in a private arbitration of an employment lawsuit brought against Wilson Elser’s client, a major construction equipment dealer. The plaintiff is a former employee diagnosed with severe autoimmune disease. The plaintiff’s suit alleges eight different causes of action, including our client failing to accommodate her disability, discriminating against her, forcing her to leave her department and failing to reassign her to a new position before terminating her employment.
During compulsory arbitration, we filed a motion for summary judgment as to all causes of action. After extensive briefing, the arbitrator, a former Magistrate Judge for the Central District of California, granted the motion and dismissed the lawsuit in its entirety.
