Austin Successfully Defends Against Insurance Administration Appeal

Heather J. Austin (Partner-Philadelphia) successfully defended against an appeal to the Circuit Court for Anne Arundel County of a Final Order by the Maryland Insurance Administration. The petitioner claims that Wilson Elser’s client, a life insurance company, mishandled her ERISA disability claim and calculated her monthly benefit in a manner that violated multiple sections of the Maryland Insurance Code. Following briefing and a hearing, the Circuit Court affirmed the Final Order of the Maryland Insurance Administration, finding that the company did not delay payment or mishandle the petitioner’s medical information and that the factual record and the applicable law support its claim decision.
