The presenters will provide an overview of protected employee speech in the workplace to help human resources and legal professionals understand the unique challenges presented by the current climate of social activism and polarization. They will explain whether and how employers may regulate or control employee speech during work or outside of work hours and away from the workplace through a review of recent events and strategies that have been effective for companies seeking to support employees engaged in social activism. Importantly, the speakers will discuss how to respond when an employer receives outside pressure to take action against employees who are politically active or engaged in off-duty conduct that may result in negative publicity for the employer.
