Joseph Stafford (Partner-Chicago, IL) will present “Coverage for Biometric Privacy Claims” on May 26, 2022, in the fourth week of the virtual Wilson Elser Insurance Coverage Master Class Series. Litigation related to biometric data continues to be a hot issue, with Biometric Information Privacy Acts (BIPA) starting to take center stage. BIPA allows individuals to bring a private cause of action against companies for failing to obtain informed consent before collecting biometric data and for not maintaining proper safeguards for its storage. Not surprisingly, as litigation has increased, so have companies’ requests for defense and indemnity coverage under their respective insurance policies. These include commercial general liability (CGL), employment practices liability (EPL), directors and Officers (D&O) and cyber insurance policies. This session will highlight the current and emerging insurance coverage issues businesses and insurers face related to these claims.
