Cynthia Maskol (Partner-Baltimore) will join a panel discussion, “No EOI Means No Coverage, so We Thought! Courts Have Different Ideas,” at the 110th Annual Education Conference of the International Claims Association to be held September 22−24, 2019, in Denver, Colorado. If an Evidence of Insurability (EOI) form is not submitted to an insurer, when requested under an employee welfare benefits plan, that coverage is not afforded. Recently, courts addressing EOI forms have concluded that coverage can still exist even if a form is not submitted. The panel will explore recent cases from the Supreme Court and underlying federal circuits that have addressed this issue. Critical legal issues to be examined include waiver, estoppel and detrimental reliance, and how to mitigate the effects of judicially imposed coverage.
