Larry H. Lum (Partner-New York) and Joseph Laird (Partner-New York) will present “The Calculus of Trial: Taking Jury Verdicts in the Face of Adverse Evidence & 'Reptile' Tactics” to the Advisory Board of Sompo Global Risk Solutions select client segments and industry verticals including real estate, hospitality, life sciences, and financial institutions and professional services. Larry and Joseph will use a case study of a premises liability lawsuit recently tried to verdict to explore the critical difference between negligence claims for property owners versus claims for product failures used in the course of property operations/ accommodations. When confronted with a serious accident caused by a known product defect, all relevant issues to be evaluated for trial purposes will be discussed, including “reptile” tactics used by the plaintiff’s bar, the actions of the injured party in causing/contributing to the accident, the suitability and effectiveness of defense/corporate witnesses, spoliation considerations and strategies employed from the outset of the claim through trial.
