Guy J. Levasseur (Partner-White Plains) and Judith Zuckerman Frantz (Of Counsel-White Plains), with assistance from Jonathn Meer, gave a presentation on negotiations to an audience of senior insurance claims professionals for an insurance company that partnered with Rutgers CMD to provide career development training for its employees. The goal was to provide the audience with a better understanding of how to effectively negotiate insurance claims from a legal perspective. The presentation addressed:

  • The strategy and timing of negotiations
  • Tactics to employ across phases of negotiations
  • A psychological-based approach to negotiating
  • Traditional and nontraditional resolution approaches in the context of litigation (i.e. out-of-the box approaches that lawyers use to resolve claims)
  • Bad faith considerations
