- Pre-trial decisions and strategy to shape and focus trials on key issues
- The use of in-trial decision making and how it affects the outcome of a trial as well as the potential of appeal
- How to respond to shifts in theory on appeal by the adversary, as well as appeal strategies after an adverse outcome in the lower courts
