The State of California Ethics: A Look at the Current State of California’s Ethics Rules and Where We Might Be Heading

Patrick Kearns (Partner-San Diego), chair of the San Diego County Bar Association’s Legal Ethics Committee, spoke on California’s ethics rules at a recent San Diego Defense Lawyers Association seminar. The presentation focused on the California State Bar’s nearly 14-year, unsuccessful process to revise and streamline California’s Rules of Professional Conduct and to bring those rules in line with the ABA Model Rules. California is the only state in the country that has not adopted some form of the ABA Model Rules. Patrick discussed some of the proposed revisions and how they shed light on what California’s Rules of Professional Conduct may look like in the future, despite the recent failure of the overall effort toward change.
