Tricks and Traps for Expert Discovery after the 2010 Amendments to Rule 26

Daniel Tranen (Partner-Edwardsville) will present a webinar on the effects of the 2010 changes to Rule 26 of the Federal Rules of Civil Procedure involving the use of consulting and testifying experts by the legal practitioner. “Tricks and Traps for Expert Discovery after the 2010 Amendments to Rule 26,” hosted by the Clear Law Institute on March 29, 2016, will begin with a synopsis of the 2010 rule changes and then shift to loopholes in the new rule and areas in which communications with experts remain at risk for discovery by opposing counsel. In the course of his discussion, Daniel will identify various “tricks” and “traps,” pointing out that while the new rules do provide heightened protection for communications with experts, not all are protected from disclosure, depending on the circumstances.
