Liquor Licensing

Overview

Liquor sales are the lifeblood of many New York businesses, particularly in the hospitality and entertainment industries. Any delay or interruption of a company’s ability to sell liquor can mean lost revenues and alienated customers – and all depends on possessing a state liquor license.

Wilson Elser helps businesses navigate the complex process for securing a liquor license, deftly identifying potential snags and addressing them to limit the prospect of costly delays or fines.

Wilson Elser helps businesses navigate the state’s complex process for securing a liquor license, deftly identifying potential snags and addressing them to limit the prospect of costly delays or fines. Our firm’s clients include restaurants, bars, hotels, caterers, sports arenas, cruise lines, liquor stores, wholesalers and a range of other businesses for which liquor sales are an essential part of the customer experience.

We help our clients sustain business success and avoid disruptions in their liquor sales by:

  • Crafting liquor permit applications so they are complete and accurate, avoiding potential rejection by the New York State Liquor Authority (NYSLA).
  • Expediting the license review process by self-certifying applications, which may allow the client to secure a license within 30 days of applying.
  • Working directly with NYSLA investigators to clarify or augment information to sustain the progress of a pending application.
  • Representing clients at community board meetings and public "500 Foot Hearings,” which are called when their business intends to locate within 500 feet of three or more other licensed establishments.
  • Gaining NYSLA approval for physical modifications or management/ownership changes at a licensed business.
  • Securing temporary permits for clients holding special or off-site events or buying a previously licensed establishment.

We understand that keeping a liquor license can be just as challenging as acquiring one. Wilson Elser helps ensure that our clients comply with all of NYSLA's Alcoholic Beverage Control Laws and regulations while offering reliable assistance when they respond to licensing queries. If a client is ever charged with violations, we are familiar with the substance and subtleties of representing them before the NYSLA.

Wilson Elser is proud to have been designated as preferred counsel to the New York State Hospitality & Tourism Industry for their liquor law matters. Our practice attorneys also are members of the Alliance of Alcohol Industry Attorneys and Consultants, the National Association of Licensing and Compliance Professionals, and the National Association of Alcoholic Beverage Licensing Attorneys.
