Brian Del Gatto and Taylor Allin presented a seminar on cross-border concerns for Canadian insurance carriers and their adjusters to one of the top five insurance carriers in Canada, client Definity Financial Corporation. The focus of the presentation was on understanding the current litigation climate and dealing with issues such as spoliation, bad faith and the all-too-common policy limit timed demands (even in clearly non-limit cases). Brian and Taylor provided suggestions for addressing issues in the pre-suit and suit stages, and how to better assess nuclear risks as a matter progresses. Real-life examples were used to illustrate the points raised. This is one of a series of educational US training modules Taylor and Brian will be doing for the company over the balance of the year to increase the awareness of the staff of the pitfalls of the US litigation system and how to navigate the Hell Holes and related issues that arise in cross border exposures that company faces.
