Jonathan Meer (Partner-New York, NY) and Tommy Spitaletto (Partner-Dallas, TX) will present “Related Claim and Interrelated Wrongful Act Analysis: ‘Those who cannot learn from history are doomed to repeat it’” on May 17, 2022, during the second week of the virtual Wilson Elser Insurance Coverage Master Class Series. Jonathan and Tommy will address the analysis of interrelated claims and related wrongful acts. The COVID-19 pandemic has led to an intense spotlight on insurance coverage disputes and the importance of policy wording. The focus on whether two matters are interrelated or if they consist of related wrongful acts based on policy language is nothing new, but courts have looked at this issue very differently. We will address examples on how the related claim and/or wrongful act analysis is applied practically, as well as its impact on other policy provisions, terms and conditions. Some practical key takeaways will assist brokers, and claims and underwriting personnel, as well as their outside professionals.
