Tom Tobin and Dan Braude (Partners-White Plains, NY) will speak on “National Transportation Safety Board (NTSB) Railroad Investigations” at the American Short Line & Regional Rail Association (ASLRRA) General Counsel Symposium to be held June 21‒22, 2021, in Louisville, Kentucky. Tom and Dan will provide insight into which rail accidents the NTSB is most likely to investigate, who might be invited to participate as a “party,” what happens while the NTSB is on scene, interaction with other stakeholders (the press, company management, plaintiffs’ attorneys and judges), how to prepare for NTSB interviews, the importance of vetting draft NTSB documents, the preparation of party submissions and preparation for in-person meetings with the five NTSB members, who are presidential appointments. Tom and Dan will actively solicit the thoughts, ideas and experiences of participants who have been through an NTSB investigation.
