Wendy Testa (Partner-Philadelphia) and Julia Manganaro, claims professional of Navigators, a brand of the Hartford, co-presented a webinar for 300 claims professionals and attorneys on November 14, 2019. In “Does Your Tender Have Teeth?” Wendy discussed the significance of drafting tenders that can be used effectively to transfer risk to a responsible party. The session included a discussion of the significance of key contract language and other elements in drafting an enforceable tender; the decision/timing to tender to another party; the difference between tendering as a contractual indemnitee or an additional insured, or both; and methods to pursue and enforce tenders to successfully manage risk and limit costs associated with litigation.
