Otis Felder (Partner-Los Angles) and Vladyslava Turner (Associate-Los Angeles) had a demurrer sustained by the Los Angeles Superior Court for Wilson Elser's client, a public port. The plaintiff is a harbor worker alleging that she was injured while working at a terminal operated by her employer, a tenant at our client's port. The court found that the plaintiff failed to comply with California's Government Claims Statute requiring that a claim first be filed with the governmental entity (our client's port, in this case) before filing suit. After sustaining the demurrer, the plaintiff petitioned the court for permission to file a late claim, asserting she was misled and that COVID-19 restrictions apply in tolling the claims period. The court's tentative ruling favored granting relief. However, during oral argument, Otis convinced the court that no misrepresentations were made in response to the plaintiff's earlier request for documents regarding her bringing a claim against the tenant and that she ignored statutory compliance requirements. Otis argued in the alternative that permitted relief is still untimely even in contemplating tolling under COVID-19 restrictions. After considering the matter, the court agreed and denied the plaintiff's petition.
