Michael Lowry (Partner-Las Vegas) submitted an amicus brief for the Las Vegas Defense Lawyers regarding the work-product protections in Nevada Rules of Civil Procedure (NRCP) 26(b)(4). Nevada's Supreme Court has not yet addressed the work-product protections, which are a daily issue for most litigants. A pending writ petition asks the court to interpret these protections in a case where a plaintiff provided her entire mediation statement to her expert, who then relied on portions of it in his report. The defendant argued that the disclosure rendered the mediation statement discoverable at that point; the plaintiff disagreed. Believing that appellate guidance on this issue would provide important clarity for the bench and bar, Las Vegas Defense Lawyers submitted an amicus brief.
