Michael Lowry (Partner-Las Vegas, NV) submitted an amicus brief for Las Vegas Defense Lawyers about the constitutionality of NRS 629.620. The statute purports to abrogate NRCP 35 for the purposes of physical or mental examinations, which has led to inconsistent decisions throughout Nevada's courts. Some courts enforce NRS 629.620, but others conclude NRS 629.620 is unconstitutional for the same reasons that Lyft v. Dist. Ct. concluded in 2021 that NRS 52.380 was unconstitutional. A defendant filed a writ petition with the Supreme Court of Nevada asking it to decide NRS 629.620's constitutionality. Michael submitted the amicus brief for Las Vegas Defense Lawyers members asking the Supreme Court to review the issue because it occurs quite frequently. Further, the split opinions within the district courts have led to unnecessary uncertainty for lawyers and clients alike.
