Thomas Nienow (Of Counsel-San Francisco, CA) obtained affirmation of a summary judgment in the Court of Appeal of the State of California First Appellate District, Division Three, on behalf of a security company. In the underlying suit, an employee of the firm’s client struck and seriously injured the plaintiffs while driving home from work. Plaintiffs alleged the firm’s client was liable for negligence, but the court granted summary judgment as a matter of law because the employee was not acting within the scope of her employment at the time of the accident. Tom obtained affirmation of this judgment.
