Erik Tomberg is an experienced commercial litigator, insurance coverage attorney and appellate advocate; he is the supervising attorney for the firm’s Raleigh, North Carolina, office.

Erik represents insurers in federal and state court litigation in disputes over a range of policies, with a focus on directors and officers (D&O) policies, as well as general liability and commercial property policies. Erik counsels clients on policy claims and negotiations and takes a pragmatic and proactive approach to resolving disputes. Erik also regularly handles commercial litigation matters and has broad trial experience, including as lead counsel in a successful trial in the U.S. District Court in Massachusetts, obtaining a judgment that was affirmed by the First Circuit Court of Appeals. He represents large financial institutions and corporations in a wide variety of commercial matters, including business contract disputes, product liability claims and creditors’ rights actions. On behalf of a federal agency, Erik has managed a large caseload of lawsuits filed in Cook County, Illinois, arising out of business loans collateralized by Chicago taxicab medallions.

Erik serves as lead appellate counsel in cases throughout the country, including in the First, Second, Sixth, Seventh, Eleventh and D.C. circuit courts of appeals, as well as state appellate courts in North Carolina, Illinois and Massachusetts and the Rhode Island Supreme Court.

In addition, Erik is an active member of the firm’s Diversity & Inclusion Committee, where he assists in developing strategies for recruiting, empowering and promoting diverse attorneys. In recognition of Asian American and Pacific Islander Heritage Month in 2021, Erik moderated a discussion on behalf of the firm regarding anti-Asian violence and hate crimes.
