Erik Tomberg is an experienced insurance coverage attorney, litigator, and appellate advocate in the firm’s Raleigh, North Carolina, office.

Erik represents insurers in coverage disputes over a range of policies, including general liability, property, directors and officers (D&O), and errors and omissions (E&O) policies. Erik advises clients on policy claims and negotiations and takes a pragmatic and proactive approach to resolving disputes. He regularly handles third-party and first-party insurance coverage litigation matters in both state and federal courts across the country. Erik has spoken widely on insurance law topics and is an active participant in the national and local insurance law community; he is a past member of Law360’s Advisory Boards for Insurance Authority – Specialty Lines and Insurance Authority – Property and served on the Insurance Law Council for the North Carolina Bar Association.

Erik serves as appellate counsel in cases throughout the country, including in the First, Second, Sixth, Seventh, Eleventh and D.C. circuit courts of appeal, as well as state appellate courts in North Carolina, Illinois and Massachusetts and the Rhode Island Supreme Court.

In addition, Erik handles commercial litigation matters and has broad trial experience, including as lead counsel in a successful trial in the U.S. District Court in Massachusetts, obtaining a judgment that was affirmed by the First Circuit Court of Appeal. He represents large financial institutions in a wide variety of commercial matters, including business contract disputes, product liability claims and creditors’ rights actions, and represents lawyers and other professionals against claims of professional liability.

Within the firm, Erik is an enthusiastic participant in firm initiatives. He serves as a mentor in the firm’s Cluster Mentoring Program for the South Cluster. He also is an active member of the firm’s Diversity, Equity & Inclusion Committee, where he assists in developing strategies for recruiting, empowering and promoting diverse attorneys. In recognition of Asian American and Pacific Islander Heritage Month, Erik moderated a discussion on behalf of the firm regarding anti-Asian violence and hate crimes.
