Katherine Beres (Partner-Detroit, MI) prevailed on a motion for summary disposition in the Ingham County Circuit Court, Lansing, Michigan, on behalf of Wilson Elser’s restaurant client. The plaintiff in this matter claimed to have sustained a significant laceration injury while using an inappropriate dining utensil at the client’s restaurant that he had not requested, but that was voluntarily provided by the client’s employee. The plaintiff argued that the restaurant employee's decision to give him the utensil was negligent and reflected the restaurant’s lack of training and supervision. In response, Kate argued that the plaintiff was provided with a common dining utensil found in many restaurants and that nothing was abnormal about the utensil or the decision to give it to the plaintiff. She further established that the only problem was that the plaintiff failed to use the utensil properly and, therefore, was solely responsible for his alleged injuries. Accordingly, the court found no evidence of negligence on the part of Wilson Elser’s client and granted summary disposition of the plaintiff's negligence claim as a matter of law.
