Lawrence Lee Washburn, IV (Partner-Atlanta, GA) and Devin P. Arnold (Partner-Atlanta, GA) obtained summary judgment in the State Court of Fulton County, Georgia, on behalf of Wilson Elser’s client, a property owner, in a premises liability matter involving an unprovoked shooting at a large retail mall in Atlanta. The plaintiff was dining on the patio of a mall restaurant when two juvenile assailants approached a nearby mall security guard and demanded access to the mall interior as part of an attempted burglary of a store. When the security guard refused, the assailants shot him. The plaintiff fled after hearing the gunfire and sustained a dislocated hip while running, subsequently undergoing total hip replacement surgery because of the injury. The plaintiff sued the mall owner, alleging negligence for failing to provide adequate security to deter the assailants from approaching the mall, and seeking $1.5 million in damages. The court granted summary judgment on all claims, concurring with Wilson Elser’s arguments in support of its motion that the injury to plaintiff was not reasonably foreseeable to the mall and that the mall owner owed the plaintiff no duty to anticipate or prevent the attack.
